​​​​​​MITIGATION INVESTIGATION​

A Mitigation Specialist is assigned to every capital case and is an integral part of the defense team. Mitigation Specialists gather clinical information. Mitigation Specialist elicit sensitive, embarrassing and often humiliating evidence that the defendant may simply never have disclosed. 

 

They recognize such things as congenital, mental and/or neurological conditions, to understand how these conditions may have affected the defendant’s development and behavior. They also identify the most appropriate experts to examine the defendant and/or testify on his behalf.

 

The Mitigation Specialist prepares the information gathered for the presentation to be made at the penalty phase of the trial should a guilty verdict occur.

Educational institutions are responsible for gathering evidence in formal Title IX complaints. The institution, not the complainant or respondent, must conduct investigations and collect facts for accurate decision-making during hearings. However, both parties have the right to gather and present evidence under Title IX regulations.

 

Institutions must respond to Title IX complaints and complete investigations promptly.  We prioritize preserving witness testimony and addressing concerns about fading or confused memories.
